Cork Babysitters Terms & Conditions


For the purposes of these Terms and Conditions, persons booked for babysitting employment through Cork babysitters are referred to as Employees and persons who contract with Cork babysitters for the purpose of employing or hiring persons booked through Cork babysitters are referred to as Employers.
Cork babysitters provide babysitting employment introduction services and will endeavour to introduce to the Employer, Employees on Cork babysitters register.


Cork babysitters undertake to ensure that all Employees on the register have been carefully selected and have demonstrated satisfactory previous experience in childcare employment. The Employer accepts that no amount of reference checking can provide a guarantee of performance by individual Employees.  Cork babysitters cannot be held accountable for negligence on the part of an Employee who has provided Cork babysitters with satisfactory references. 
Cork babysitters’ selection procedure includes the following: A written application by the applicant, identity checks by sight of documents and records supporting the applicant’s identity followed by a face to face interview. References are then taken and Cork babysitters requires that a minimum of two childcare references are verified verbally to allow referees to give a more full, frank and candid picture in discussion than they would when asked to provide information in writing. The application and notes of the references received are finally reviewed, approved and signed off by a Director of the company before each successful applicant is admitted to Cork babysitters’ register. 


Cork babysitters will always use its best endeavours to fill a booking providing a minimum of twenty four hours notice is given.  Wherever possible Cork babysitters will ensure that the Employers bookings are offered to their preferred babysitters first The Employer accepts that Employees on Cork babysitters register are free agents and Cork babysitters is not able to require any particular individual to work at any time or for any particular Employer.

The following Terms and Conditions apply:

Fees

1. The Employer pays a membership subscription; in return the Employer is permitted to book Employees on Cork babysitters’ Register to work for the Employer.

2. There are no further fees due to the agency.

3. Membership fees are inclusive of VAT at 21%.

4. Cork babysitters undertakes to give the employer a minimum of 30 days notice of any change in membership or booking fees, unless such a change is due to a change in VAT. The employer may cancel their membership of Cork babysitters at any time without penalty.

 

Employees’ pay 
1. Cork babysitters’ acts as an introduction service only and does not employ child carers or any Employees booked by Employers.

2. The Employer therefore has sole responsibility for establishing the terms and conditions of the employment of the Employee and the Employee is at all times under the direction, control and supervision of the Employer.

 

Conditions

1. In paying a membership fee the Employer undertakes to make all bookings with Employees through Cork babysitters. Private approaches to Employees are not permitted without the agreement of Cork babysitters. If an Employer is found to have made an offer of childcare employment to an Employee beyond the scope of the original booking made through Cork babysitters the Employer’s membership will be cancelled with immediate effect. No refund of membership fees paid will be made and no further bookings will be accepted. The Employer will be liable in damages to Cork babysitters to compensate Cork babysitters in respect of all past present and future losses which Cork babysitters suffers by reason of any breach of the undertaking above.

2. References given by Child carers are verified with the referees verbally as Cork babysitters believes referees give a more full, frank and candid picture in discussion than they would if asked to provide information in writing.  For this reason Cork babysitters cannot provide copies of written references.

3. The Employer accepts that Cork babysitters’ responsibility is to introduce Employees who have demonstrated previous satisfactory childcare employment experience, in line with reference checks set out herein.

4. The Employer is responsible for the instruction and direction of the Employee for the duration of the babysitting appointment. The Employer is responsible for ensuring the Employee clearly understands the needs of the Employer’s children and the Employer’s expectations of the Employee’s performance of duties.

5. Cork babysitters have no responsibility for an Employee’s acts or omissions when under the direction, control and supervision of the Employer.

6. In the event that an Employee is booked and for reasons beyond Cork babysitters control cancels at short notice or fails to arrive at the appointed time Cork babysitters will use its best endeavours to find another Employee for the Employer.

7. Cork babysitters are not responsible for any loss as a result of the Employee’s failure to keep the appointment.

8. While the Employer employs an Employee from an introduction made by Cork babysitters the Employer undertakes to reimburse Cork babysitters fully for all costs, claims, damages, and liabilities whatsoever arising from the Employer’s wrong doing or negligence.

9. Cork babysitters reserve the right to terminate any membership either when the current paid membership expires or by giving the Employer 14 days notice and a refund of any un-expired membership fee. Cork babysitters also reserve the right to terminate any membership without prior notice if it believes that the Employer has violated any of the Terms of the Service. 

10. In case of any dispute Irish law shall apply.
